General Terms and Conditions (GTC)

Small Business Regulation: The Seller is a small business owner according to § 19 para. 1 of the Austrian Value Added Tax Act (UStG). The prices stated in the shop are final prices. Value added tax is not shown separately; it is not charged and does not need to be shown.

These GTC govern all contracts between the Seller and buyers (consumers or businesses) regarding the sale of organic products from Greece via the online shop at www.gerrys-treasure-box.com

Scope: These terms and conditions apply to all orders, offers, and deliveries. Deviations or additional terms and conditions of the buyer are only recognized if the Seller expressly agrees to them in writing.

2. Conclusion of Contract
The contract is concluded as follows:

The buyer submits a binding offer to purchase by placing the desired products in the shopping cart and confirming the order by clicking on "Buy Now" or "Complete Order".

The seller confirms the conclusion of the contract by sending a confirmation email (order confirmation). The contract is then concluded.

All product descriptions, images, and prices in the shop are non-binding offers from the seller.

3. Product Descriptions and Availability
The products are organically grown in Greece. The seller guarantees that all products comply with applicable organic certifications and EU organic regulations.

All product descriptions, images, information on origin, composition, and nutritional values are correct to the best of the seller's knowledge. The seller assumes no liability for printing errors or discrepancies that may arise due to different batches or seasonal variations.

4. Prices and Payment Terms
Pricing:

All prices listed in the shop are final prices in euros (EUR).

Since the seller is a small business owner according to § 19 of the Austrian Value Added Tax Act (UStG), VAT is not charged or shown. The prices quoted are both gross and net prices.

Shipping, packaging, and handling costs are shown separately and added to the price.

Customs duties, import taxes, and other charges for shipments outside of Austria are the responsibility of the buyer.

Price updates: The seller reserves the right to change prices at any time. The price displayed in the shop at the time of ordering is the applicable price.

Payment methods: The buyer accepts the following payment methods:

Credit card (Visa, Mastercard)

PayPal

Bank transfer/SEPA transfer

Instant bank transfer/Online banking

Invoice (upon request and subject to credit check)

The seller reserves the right to exclude or add certain payment methods.

Payment due date: Payment is due immediately upon receipt of the invoice or conclusion of the contract, unless a different payment term has been expressly agreed upon. For payment methods such as credit card or PayPal, payment is processed immediately.

5. Late Payment and Reminder Fees
If payment is not received within 14 days of the invoice date:

The buyer will receive a written reminder (by email or letter).

After a further 7 days (a total of 21 days), a reminder will be sent with a reminder fee (EUR 2.00–5.00).

In case of repeated non-payment, further reminders and fees may follow.

The seller reserves the right to charge default interest at a rate of 5% above the base interest rate per annum.

In the event of continued non-payment, the seller reserves the right to initiate legal debt collection proceedings.

6. Delivery
Delivery Terms:

The seller ships ordered products to the delivery address provided by the buyer.

Delivery times are estimates and begin upon receipt of payment. The seller strives to meet delivery deadlines but cannot guarantee them.

Shipping is handled by contracted logistics partners.

Delivery Regions: The seller delivers within Austria, the EU, and selected countries. A complete list is displayed in the shop.

Delivery in case of unavailability: If a product is unavailable, the buyer will be informed and will receive a full refund or can choose an alternative product.

Retention of title: The delivered products remain the property of the seller until full payment has been received.

7. Shipping costs and conditions

Shipping costs are displayed transparently before order completion.

Shipping costs depend on the delivery country and region.

The seller ships organic products from Greece and complies with all applicable EU import and hygiene regulations.

Packaging is done with care to preserve the products' shelf life and protect the environment.

Delivery delays due to customs clearance or official inspections are possible and are not the responsibility of the seller.

8. Returns and Refund Policy
Right of withdrawal for consumers:

Consumers (private individuals) have the right to withdraw from their order within 14 days of receiving the goods without having to give any reason.

Exceptions to the right of withdrawal:

The right of withdrawal does not apply or is reduced for spirits that have already been partially or completely consumed or opened, as these cannot be returned for hygiene reasons and legal requirements.

The right of withdrawal does not apply if the original packaging is sealed or damaged (unless the damage is clearly due to transport).

Withdrawal form: A sample withdrawal form is sent with every order.

Return shipping costs: The buyer bears the costs of return shipping, unless the seller is obligated to return the goods due to a defect or transport damage.

Refunds: Refunds are issued within 14 days of the return and verification of the product's condition.

9. Warranty and Liability for Defects

The seller provides a warranty in accordance with Austrian law:

For new goods: 24 months from the date of purchase

For used goods (where applicable): 12 months from the date of purchase

Reporting Defects: The buyer is obligated to report any obvious defects in writing immediately upon receipt (at the latest within 2 weeks).

Transport Damage: Transport damage must be:

reported to the delivery service (logistics partner) immediately and documented in writing,

reported to the seller within 3 days of receipt.

A claim must be filed so that the seller can assert the claim against the transport company.

Manufacturer's Warranty: If a product has a separate manufacturer's warranty, these rights remain unaffected by these Terms and Conditions.

10. Limitation of Liability

The seller is liable as follows:

Unlimited liability: in cases of intent, gross negligence, and damages to life, body, or health.

Limited Liability: The seller is not liable for damages caused by slight negligence, in particular for:

Data loss or data corruption

Lost profits

Indirect damages

Delays in delivery (except in cases of gross negligence)

This limitation of liability does not apply to the extent that mandatory laws (e.g., consumer protection laws) provide for other liability.

11. Data Protection and Data Security
The seller processes the buyer's personal data exclusively:

for contract fulfillment (delivery, payment processing),

for compliance with legal obligations,

for customer support and marketing (with separate consent).

Customer Rights: The buyer has the right to information, rectification, erasure, restriction of processing, data portability, objection, and withdrawal of consent regarding their data in accordance with the GDPR.

Disclosure to Third Parties: Personal data will not be sold or disclosed to third parties without consent,

except when necessary for contract fulfillment

(e.g., to logistics partners, payment service providers).

12. Special Regulations for Organic Products from Greece
Since Gerry's Treasure Box products are imported from Greece:

Shipping is carried out in compliance with all applicable EU hygiene, transport, and customs regulations.

Organic certificates and product approvals are verified according to Austrian and EU law.

In certain countries, import duties and taxes apply, which the buyer must pay.

The buyer is responsible for complying with applicable customs laws and import regulations of the destination country.

Delivery delays due to customs clearance or official inspections are not the responsibility of the seller.

The seller assumes no liability for delays or rejections by customs authorities or national health authorities.

13. Dispute Resolution and Mediation
Consumer Protection: Consumers can contact the following organizations in case of disagreements:

Out-of-court settlement: The seller is not obligated to participate in dispute resolution proceedings but is willing to resolve conflicts fairly.

14. Final Provisions
Applicable Law: These Terms and Conditions and all contracts are governed exclusively by Austrian law.

Jurisdiction: If the buyer is a consumer, the seller may bring legal action against the buyer in the courts of the country where the buyer is located. If the buyer is a business, the courts of jurisdiction under Austrian law shall apply to any disputes.

Severability Clause: Should any provision of these Terms and Conditions be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. Any invalid clause shall be replaced by the applicable statutory provisions.

Amendments to the Terms and Conditions: The seller reserves the right to amend these Terms and Conditions in writing with reasonable notice (at least 14 days) if changes in legislation or market conditions make this necessary.

Language: These Terms and Conditions are written in German. In the event of any discrepancies between the German version and a translation, the German version shall prevail.
