Refund Policy

1. Scope   
This refund policy applies to all purchases of organic products in the Gerrys Treasure Box online shop at www.gerrys-treasure-box.at and governs the conditions for returns, cancellation, and refunds for consumers (private individuals) under Austrian law and EU distance selling regulations.

2. Statutory Right of Withdrawal   
Duration of the Right of Withdrawal
Consumers have a statutory right of withdrawal of 14 days from the day they receive the goods (not from the date of order) when purchasing organic products online, without having to provide any reason.

The period begins when you or a third party designated by you (not the shipping provider) receives the goods.

Exercising your right of withdrawal
To exercise your right of withdrawal, you must notify us of your decision to withdraw from this contract within 14 days of receiving the goods by email or letter to:

The notice of withdrawal is considered timely if it is sent within the 14-day period.

This form is optional; other unambiguous statements (e.g., an email stating "I wish to cancel my order") are also valid.

3. Exceptions to the Right of Cancellation   
Food and Sealed Goods
The right of cancellation does not apply or is limited for goods that are intended to be sealed for reasons of health or hygiene protection and whose seal has been removed after receipt.

This applies in particular to:

Organic products that have already been opened or partially consumed

Products with damaged or removed original seals

Perishable food items after opening

Products where hygiene or integrity is compromised

Important: As long as the original seal is intact, you have the full right of withdrawal.

Warranty claims remain valid
Regardless of the exceptions to the right of withdrawal, you retain your statutory warranty rights: If a product arrives defective, faulty, or damaged, you can request a replacement, repair, or refund, regardless of whether the seal is damaged.

4. Return Procedure   
Step 1: Submit your notice of withdrawal   
Submit your notice of withdrawal by email, letter, or telephone (see section 2). Save a copy or proof (e.g., email confirmation).

Step 2: Prepare and return the goods
Carefully pack the goods in the original packaging (if available). Please ensure that:

The original seal is intact (if present)

All accompanying documents or invoices are included

You include proof of shipment (tracking) (important as proof of return!)

Note: The buyer is responsible for return shipping costs unless the seller is obligated to cover the return shipping due to a defect, incorrect delivery, or damage during transport.

Step 3: Proof of Shipment   
Use a shipping service with tracking (e.g., Post, DHL, GLS). The goods are considered returned on time if they are shipped within 14 days of submitting your cancellation notice.

Keep your proof of shipment and provide the tracking number to the seller (optionally via email) to expedite the return process.

Step 4: Inspection and Refund   
After receiving and inspecting the returned goods, your refund will be processed within 14 days. The refund will be issued using the same payment method used for the original transaction (e.g., credit card, PayPal, bank transfer), unless explicitly agreed otherwise.

5. Refunded Amounts   
What will be refunded?

Upon successful return, the following amounts will be refunded:

✅ The full purchase price of the products

✅ The standard shipping costs of the original delivery

✅ Payment fees (e.g., payment service provider fees), if already paid by the buyer

What is not refundable?

The following are not refundable:

❌ Additional costs incurred due to a premium or express delivery method you selected (if it was more expensive than standard delivery)

❌ Customs duties, import taxes, or other official fees originally paid by the buyer

❌ Return shipping costs (unless the seller is at fault, see section 4)

❌ Costs incurred due to return shipping insurance you purchased


6. Damage in transit and incorrect deliveries   
For damaged or incorrect products
If the goods arrive damaged or do not match the purchased item, you have the following rights, irrespective of the 14-day right of withdrawal:

Report immediately: Contact the seller within 3 days of receipt by email or telephone and document the damage (photos are helpful).

Report to the delivery company: Also inform the shipping company of the damage in transit and request a written damage report. This is important because the seller will claim damages from the logistics partner.

Return or replacement: After inspection, the seller will provide you with a return label, send a replacement, or refund the purchase price (including shipping costs).

In the case of transport damage, the seller will bear the return shipping costs.

7. Refund processing time   
After receiving the returned goods and verifying their condition, the refund will be processed within 14 days. This period may be extended if the goods are damaged or cannot be located.

You will receive a confirmation email as soon as the refund has been initiated. Depending on the payment method, the credit may take 3–5 business days (for bank transfers) or up to 30 days (for credit card refunds).

8. Warranty rights (independent of the right of withdrawal)
In addition to the right of withdrawal, you have statutory warranty rights:

Liability for defects: 24 months for new goods; 12-month warranty for used goods

Right to repair or replacement: If a product is defective

Right to a refund: If repair is not possible or has failed

Deadline for complaints: Obvious defects must be reported within 2 weeks of receipt

These rights are independent of the 14-day right of withdrawal and may be exercised beyond the 14-day period.

 

9. B2B Purchases (Businesses)   
Different regulations apply to business purchases (B2B). The 14-day consumer right of withdrawal does not apply. Returns, replacements, and refunds for B2B purchases are subject to negotiation and must be agreed upon separately. Please contact the seller for individual arrangements.

11. Deviations and Amendments   

These refund policies supplement the General Terms and Conditions (GTC) of Gerry's Treasure Box. In the event of any conflict between these policies and the GTC, the GTC shall prevail. See: GTC

The seller reserves the right to amend these refund policies with reasonable notice (at least 14 days) if laws or terms and conditions change.
